When a person is convicted of a crime or otherwise believed to have profited from criminal activity, they may become the subject of proceedings brought by the Assets Recovery Agency.

Following a conviction, the ARA can apply to the Crown Court for an order that assets derived from Criminal Activity be confiscated. Enforcement proceedings can then be brought in the criminal courts.

Where Criminal prosecution has failed or proved impossible to complete, The ARA can bring civil proceedings to seek to recover assets they believed were obtained through unlawful conduct.

Andrews Angel Solicitors will be able to guide clients through these procedures and seek to avoid or minimise any potential liability.

In some cases, prior to trial, the ARA will seek to prevent dissipation of assets by obtaining a restraint order to prevent a Defendant dealing with their assets. Such orders can cause significant hardship. Andrews Angel will be able to take the appropriate actions to respond to these steps.
