The Corporate Manslaughter and Corporate Homicide Act 2007 will implement significant changes to the law from April 2008. This will see changes to the way in which Companies can be prosecuted following a fatality.
You may read of many law firms gearing up to this legislation as if it means that companies can now be prosecuted for manslaughter. This is simply not the case. There is a long history of companies being prosecuted for manslaughter. The new law changes the basis upon which a prosecution can be brought.
The new legislation will not just have an impact on companies but also those who make decisions within companies regardless of their status and those whose actions may fall to be scrutinised following a fatality.
