The number of prosecutions in the criminal courts for breach of Trade Mark and Copyright Law is increasing year by year.

Prosecutions are brought by the police, local government trading standards departments and private organisations such us British Phonographic Industry.

Such prosecutions are pursued against individuals and organisations. Many prosecutions are brought in respect of alleged fake or "pirated" items such as DVDs or clothing items.

The penalties on conviction for such offences can be severe, a maximum period of imprisonment of up to 10 years in some cases. In addition the prosecution also seek confiscation orders against the accused persons whereby large amounts of cash can be confiscated which can have a devastating effect not only on the accused but also their families.
